RENTAL AGREEMENT

THIS AGREEMENT, entered into this ________th day of ______________, 20___, by and between Tom and Rosann Moran and ______________________________, hereinafter called respectively lessor and lessee. WITNESSETH: That for and in consideration of the payment of the rents and the performance of the covenants contained on the party of lessee, said lessor does hereby demise and let unto the lessee, and lessee hires from lessor for use as a residence those premises described as 311 Ocean Blvd., located at 311 Ocean Blvd., Coronado, California, for a tenancy commencing on the ________ day of ____________, 20___, (a Saturday) at 3PM. and a rental of $________________ for the entire period of time, payable half in advance and remaining half upon arrival. "Check out" time is 9:00 AM (if lessee is unable to entirely vacate the premises at 9:00 AM, then at least the lessee will allow the cleaning crew access to the house, so that the cleaning process can begin) on the _________ day of _______________, 20____, (a Saturday). It is the arrival of the deposit that reserves the dates. It is further mutually agreed between the parties as follows:

(1) Said premises shall be occupied by no more than ___________adults and __________ children.

(2) Lessee shall not keep or permit to be kept in said premises any dog, cat, parrot, or other bird or animal except for ________________________________________. If an animal is keep or permitted to be kept in said premises, then the check out time changes to 9:00AM in the morning on the Saturday of departure. This is to allow for a "fumigation." Remember sand fleas are endemic to beaches in southern California.

(3) Lessee shall not violate any city ordinances or state law in or about said premises.

(4) That all alterations, additions, or improvements made in and to said premises shall, unless otherwise provided by written agreement between the parties hereto, be the property of Lessor and shall remain upon and be surrendered with the premises.

(5) Lessee shall not sub-let the demised premises, or any part thereof, or assign this agreement without the lessor's written consent.

(6) Any failure by lessee to pay rent or other charges promptly when due, or to comply with any other term or condition hereof, shall at the option of the lessor, and lawful notice given, forthwith terminate this tenancy.

(7) Lessee shall keep and maintain the premises in clean and sanitary condition at all times, and upon the termination of the tenancy shall surrender the premises to the lessor in as good condition as when received, ordinary wear and damage by the elements excepted.

(8) Except as to any condition which makes the premises untenantable, lessee hereby waives all right to make repairs at the expense of lessor as provided in Section 1942 of the Civil Code of the State of California, and all rights provided in Section 1941 of said Civil Code.

(9) Tom and Rosann Moran agrees to properly cultivate, care for and adequately water the lawn, shrubbery, trees and grounds.

(10) Tom and Rosann Moran shall pay for all water supplied to the said premises. Tom and Rosann Moran shall pay for phone service supplied to the said premises (one phone line). Tom and Rosann Moran shall pay for a reasonable amount of gas, heat, light, power and all other services, except as herein provided, supplied to said premises.

(11) Nothing contained in this agreement shall be construed as waiving any of lessor's rights under the laws of the State of California.

(12) This agreement and the tenancy hereby granted may be terminated at any time by either party hereto by giving to the other party not less than 60 days notice in writing, prior to the first day of tenancy (as noted above). Deposit is non-refundable after passing the 60 day limit, but time may be sublet with Tom and Rosann Moran's written agreement. Any moneys beyond what the original agreed upon rent, shall be refunded to the lessee. (Lessor's note: There are some exceptions to this 60 day-100% refund policy. But rest assured that if one of these "exceptions" applies, then this will be made clear prior to us accepting any deposit money)

(13) Tom and Rosann Moran shall provide a cleaning service every "inbetween" Saturday (not to be confused with the "tenancy commencing" Saturday--see top paragraph above) at about 9:00AM, including a change in linen. The cleaning service does a more complete job when they have the house to themselves, but this is entirely up to the lessee. They will clean as little or as much as the lessee wishes. This service is completely optional. If the renter would prefer their privacy, simply inform Tom Moran and the cleaning crew will not show up on the "inbetween" Saturdays.

(14) The prevailing party in an action brought for the recovery of rent or other moneys due or to become due under this lease or by reason of a breach of any covenant herein contained or for the recovery of the possession of said premises, or to complete the performance of anything agreed to be done herein, or recover for damages to said property, or to enjoin any act contrary to the provision hereof, shall be awarded all of the costs in connection therewith, including, but not by way of limitation, reasonable attorney's fees. _________________________________ _____________________________
